Key Provisions of the Draft Order

The draft order frames its rationale in terms of national security, arguing that “coordinated disinformation and defamatory campaigns” against the government and its officials on social media platforms “weaken public trust, empower foreign adversaries, and constitute a form of domestic insurrection.”

Its most explosive provisions include:

  1. Redefining “Treasonous Activity”: The draft expands the legal definition of actions that “aid and comfort” the nation’s enemies to include the “willful dissemination of knowingly false, misleading, or derogatory information about United States government officials, operations, and policies with the intent to undermine public faith and hinder government functions.”
  2. Establishing a “Digital Patriotism” Task Force: This interagency body, to be led by the Attorney General, would be empowered to “identify, investigate, and refer for prosecution” individuals and groups deemed to be engaged in “systematic online defamation and treachery against the United States government.”
  3. Platform Liability: It directs the Department of Justice to explore legal avenues to hold social media platforms accountable for “facilitating treasonous speech” if they do not aggressively remove content flagged by the Task Force.
  4. Asset Seizure and Penalties: The order suggests exploring severe penalties for convicted individuals, including significant fines, potential asset forfeiture, and lengthy prison sentences, citing statutes related to sedition and espionage.

Immediate and Fierce Backlash

Reaction from legal experts, civil liberties groups, and political opponents was swift and severe.

“This isn’t a policy proposal; it’s a blueprint for tyranny,” said Eleanor Vance, president of the First Amendment Defense Coalition. “The Founding Fathers designed the First Amendment precisely to protect harsh, even unfair, criticism of those in power.
